General terms and conditions of sale
Preamble :
The seller is a publisher of caving and canyoning products and services for consumers marketed through its profundo.fr website. The list and description of goods and services offered by the company can be consulted on the aforementioned website.
These general terms and conditions of sale set out the rights and obligations of the parties in connection with the online sale of products or services offered by the seller.

Conditions of participation :
The activities on offer are open to all, but depending on the activity and route, certain conditions must be taken into account: age limit, technical or physical level. To find out what these conditions are, please refer to the technical data sheets for the routes and ask your contact person for advice if necessary at 0692421605 or contact@profundo.fr.
You must not have any medical contraindications to the chosen activity (caving, canyoning, etc.).
Practising them requires a variety of progression (bending, standing, crawling, walking on uneven or slippery ground, climbing...) and therefore a minimum level of physical fitness, knowledge of one's abilities and openness about any health concerns that are not compatible (heart or joint problems, prostheses, advanced pregnancy...).
If you have no medical contraindications but are dependent on special care or treatment, or if your state of health requires special attention, you must inform the office at the time of booking and the instructor at the start of the activity.
The instructor reserves the right to refuse access to the activity if he considers that a participant's condition does not allow him to ensure his safety.
This refusal may apply if the participant is under the influence of alcohol or drugs.
Every effort is made to ensure the safety of participants, but the natural environment includes inherent risks that you need to be aware of (progress over abrasive or slippery terrain, falling rocks or branches, puncture wounds, etc.).
For aquatic activities, you must be able to jump into the water, swim on your stomach for twenty metres, swim underwater and pass under a water line or floating object.
Insurance
Your instructor is covered by professional indemnity insurance for the activities he or she supervises, in accordance with his or her qualifications and prerogatives (see the Who am I? page).
However, you are strongly advised to take out individual insurance cover (civil liability and personal accident cover) for damage caused by accidents or incidents that are not directly related to the activities or that do not result from a fault on the part of the instructor or a defect in the equipment.
Cancellation policy
All bookings can be cancelled at least 48 hours before the activity.
Failure to attend an unannounced activity will result in full payment of the initial fee.
The supervision of outdoor activities may lead to cancellations due to weather or volcanic conditions (eruptions, seismic crises).
The instructor reserves the right to cancel an activity for reasons of safety or force majeure.
Only the instructor is authorised to cancel an activity.
It undertakes to inform those registered as soon as possible and to offer them either a change of venue, a later date or cancellation of the activity.
Please remain contactable the day before and the day of the activity and inform the instructor of any communication problems.
Late arrivals can penalise an entire group or even jeopardise the entire planned activity.
Please let us know as soon as you realise that you will not be able to make the scheduled appointment time, so that we can optimise the organisation accordingly.
Réunion Island can have serious traffic problems at certain times of the day or during certain periods, so be sure to plan your itinerary well in advance, as GPS systems sometimes fail to reflect local reality.
A maximum delay of fifteen minutes will be tolerated, after which time the instructor will leave the activity and payment for the outing will remain due for the latecomer.
Audiovisual property and image rights
The instructor reserves the right to use the photos or videos taken during its services to illustrate its brochures, various advertisements, social networks and website, unless otherwise specified by the participant.
In accordance with the French Data Protection Act no. 78-17 of 6 January 1978, you have the right to access, rectify or delete any information concerning you.
Flights
The company declines all responsibility in the event of theft or loss of equipment in the vehicles. Do not leave anything in sight on the site and try to avoid leaving money or valuables there.
Litigation - consumer mediation
In the event of a dispute between the Customer and the company, they shall endeavour to resolve it amicably (the Customer shall send a written complaint to the professional or, where appropriate, to the professional's Customer Relations Department).
In the absence of an amicable agreement or in the absence of a response from the professional within a reasonable period of one (1) month, the consumer Customer within the meaning of article L.133-4 of the French Consumer Code has the possibility of referring the matter, free of charge, if a disagreement remains, to the competent mediator registered on the list of mediators drawn up by the Commission d'évaluation et de contrôle de la médiation de la consommation pursuant to article L.615-1 of the French Consumer Code, namely :

Booking an activity implies acceptance of these general terms and conditions of sale.
The customer certifies that he/she has read the general and special terms and conditions of sale and undertakes to inform the participants in his/her group of all the terms and conditions.
